I sympathise with your problem, but the buck must stop with you.
Epicormic shoots are an everpresent hazard in our industry, and as you said, eucalypts are a fast growing species that exhibit this tendency.
What of your corporate training ? A climber that cannot recognise a tree that has been topped, should I suggest, not be climbing.
Education of the public over time that trees are living organisms that require specialist care, and are not just personal or public possessions in a garden or street, WILL in time help to prevent topping.
I personally doubt that legal action against a non believer will be the answer - maybe it will help.
