In the United Kingdom trees are protected by a national ACT OF PARLIAMENT The Town & Country Planning Act 1990 Section 8 "Special Controls Trees", this places a "DUTY" (in the legal sense) on the local planning authority to provide appropriate planning ordinances at the time of any application for permission to build. The Act further requires that Local Government make such tree preservation orders on any tree visible to the public considered worthy of protection as an amenity, highway trees can also be protected. Fines for violation of TPOs are 30000 dollars for removal of a protected tree, damage likely to destroy, etc or twice the value of the tree as the Court determines and unlimited fines if land gain is involved.
